PHILADELPHIA, Dec. 10 (UPI) -- The American Civil Liberties Union says a Pennsylvania high school had no right to punish a student who mocked the principal on a MySpace.com Web site.
Attorneys for Justin Layshock, now a 20-year-old college student, say he was wrongly suspended for 10 days, banned from after school academic programs and transferred to a less rigorous "alternative" education program by the Heritage School District in Mercer County, Penn., the Philadelphia Inquirer reported Wednesday.
The moves allegedly came after Layshock made fun of Principal Eric Trosch on a bogus MySpace.com page, inferring he drank and pointing out his large build, ACLU attorneys told the newspaper.
A federal appeals court was set Wednesday to hear the case in Philadelphia. A 2007 U.S. District Court ruling found in the student's favor, which was appealed by the Heritage School District with support from the Pennsylvania School Boards Association.
