OKLAHOMA CITY, Dec. 3 (UPI) -- The Oklahoma Supreme Court is considering a legal battle between a Catholic preschool and the operators of a pit bull kennel next door.
The crux of the conflict is a state law that bars dog kennels from operating within 2,500 feet of a school in larger cities but also contains a grandfather clause for kennels that already had operating licenses before the law was enacted.
The Oklahoman said Wednesday that the problem stemmed from the nebulous nature of the kennel's license at the time. Owner Kenneth Gonzales was in the process of obtaining a license when the law went into effect.
Gonzales filed a suit in Oklahoma County against Oklahoma City and the state, saying the law was unconstitutional. The nuns who run the preschool sued Gonzales in Cleveland County.
To make a long story short, Gonzales and the nuns both prevailed in the cases they filed. Both cases were also appealed by the losing parties.
The Oklahoman said the state Supreme Court heard the case Tuesday and will rule at a later date.
