VISTA, Calif., Nov. 6 (UPI) -- A San Diego police officer will stand trial in relation to an off-duty shooting linked to an incident of road-rage, a judge in Vista, Calif., says.
Vista Superior Judge Joel Pressman criticized San Diego police Officer Frank White for allegedly brandishing and firing his gun following a conflict with a fellow driver in Oceanside, Calif., the San Diego Union-Tribune said Wednesday.
"I think we expect more from our officers than the conduct that was displayed here," Pressman said Wednesday while ordering White to stand trial.
White has been charged with grossly negligent discharge of a firearm and exhibiting a firearm in relation to the March 15 incident.
Police allege the 28-year-old officer wounded Rachel Silva and her son when he fired five shots into her vehicle after she got into a conflict with the off-duty officer.
Defense lawyers have accused Silva, 28, of using her own vehicle as a weapon in the dispute. Silva allegedly had a 0.15 blood alcohol level when the incident occurred, police say.
White's arraignment on the felony and misdemeanor charges has been set for Dec. 3, the newspaper said.
