U.S. District Judge Gregory Wu ruled against Lori Drew's lawyers on two of their arguments. But he said he needs a few days to consider a claim that Drew could not be charged with violating MySpace's terms of service when there is no evidence she had read them, the St. Louis Post-Dispatch reported.
Drew, a resident of Dardenne Prairie, Mo., was charged under the Computer Fraud and Abuse Act. She allegedly participated in an online relationship between Megan Meier, 13, and a teenage boy, a fictional creation.
The teenager, a neighbor and former friend of Drew's daughter, hanged herself after receiving a hostile communication from the supposed boy.
After federal and state prosecutors in Missouri said they could find no way to prosecute Drew, so charges were brought in Los Angeles, where MySpace computers are located.
