
LOS ANGELES, June 11 (UPI) -- Federal prosecutors in California have asked a judge to hold Broadcom founder Henry Nicholas without bail.
In their motion, prosecutors say surveillance video shows Nicholas used drugs while he was under investigation, The Orange County Register reports.
The videos were posted briefly on YouTube last year and copies sent to some newspapers and to police. Nicholas was indicted last week on federal securities fraud and drug charges.
"Defendant continued to engage in illegal drug activities while the federal investigation was ongoing," prosecutors said in their motion.
Gregory Craig, Nicholas's attorney, argued the videos at worst show only one use of drugs. He said Nicholas has passed numerous drug tests since 2006 as part of a legal fight with his ex-wife over access to his children.
Nicholas is now in a drug rehab facility in Malibu.
