U.S. woman sues over baby's deportation

CORPUS CHRISTI, Texas, June 4 (UPI) -- A Texas woman says she won't quit her legal battle against the U.S. government for deporting her baby to Mexico along with her undocumented ex-boyfriend.

Monica Castro, a native-born American from Corpus Christi, is seeking $5 million in damages on the grounds agents acted outside their authority in 2003 by making a child-custody decision and shipping her daughter, who is also a U.S. citizen, off to a foreign country.

"I did everything I could to prove she was a U.S. citizen," Castro told the Fort Worth Star-Telegram Wednesday. "It was like I was there for nothing."

The U.S. attorney's office had no comment other than contending the Border Patrol acted within its authority, rendering the lawsuit groundless.

The government won the first round in U.S. District Court. Castro's appeal went before an appellate court in New Orleans Wednesday.
