NEW YORK, May 28 (UPI) -- A New York lawyer is suing Delta Airlines for $1 million for ruining a vacation in honor of his mother's 80th birthday.
Richard Roth says a Delta worker in Atlanta caused his family to miss their flight to Argentina forcing them to drive to Miami to get seats on another airline, The New York Post reported Wednesday.
The final straw, Roth says, was when Delta lost the family's luggage.
Roth said the trouble began after their flight to Atlanta left Westchester, N.Y., almost two hours late.
When they tried to board the connecting flight to Buenos Aires, a Delta agent told them "the flight had already taken off," the Post report said.
Roth says the aircraft was still at the gate but the agent wouldn't let them board even though the aircraft remained there for another 20 minutes.
After a night in a motel, Delta told the family they couldn't get on another flight to Argentina for 19 days, the Post said.
