Jennifer Gabrysh was injured in July 14 accident at a house party in Regina Beach, the Regina Leader-Post reported.
The suit seeks undisclosed damages for damages for pain, suffering and disability, loss of income and homemaking capacity and the costs of her care, the newspaper said.
The suit claims Gabrysh was standing at the side of the pool close to the deep end when one of the claimants threw a football "in such a fashion that Jennifer was required to jump towards the interior of the swimming pool to catch" it," the report said. It also said the unidentified man had a "duty of care to Jennifer to throw the football in such a manner so as to avoid any foreseeable risk of injury."
As for the homeowners, the suit claims "at no time did anyone provide any instruction, guidance or warnings with respect to the swimming pool."
The woman's dive fractured her 5th cervical vertebra and damaged her spinal cord, the suit said.
