Jury awards $3.7 million in troubled birth

INDIANAPOLIS, Feb. 28 (UPI) -- A jury in a malpractice case awarded an Indiana woman and her daughter $3.7 million for delivery delays that resulted in cerebral palsy.

Indiana limits on medical malpractice awards will reduce the judgment against Dr. Sally Bradley and St. Vincent Hospital in Indianapolis to just under $2 million, the Indianapolis Star said Thursday.

Attorneys for Robin Lynch and her daughter, Shelby, who is now 6, said Shelby began showing signs of fetal distress while her mother, who was bleeding, waited for a Cesarean section to be performed. The girl didn't start breathing until 12 minutes after her birth. The newspaper said the mother also developed a serious bleeding disorder and had to go back into surgery for removal of a sponge that was left behind, the newspaper said.

A state medical review panel had issued an advisory finding of no malpractice on two of the three claims.
