Drug liability case to impact consumers

BOSTON, Dec. 20 (UPI) -- A Massachusetts court ruling holding doctors responsible for disclosing all possible side effects of medications exposes professionals to further lawsuits.

The Massachusetts Supreme Judicial Court ruled 4-2 Dec. 10 the doctor of a man who passed out while driving and fatally struck a 10-year-old boy was responsible for failing to disclose the possible side effects of his prescription medicine.

The decision is likely to cause an increase in malpractice insurance costs, which will translate to higher consumer prices and decrease access to care for patients, the Washington Times said Thursday.

The mother of the 10-year-old boy sued Sacca's doctor, Ronald Florio, because he released him to drive despite the depressive qualities of his medication.

The court found Florio's ethical responsibility included warning of possible side effects that may jeopardize others' safety.

Medical professionals fear the case limits future prescriptions as patients may be hesitant to take medicines with possible harmful side effects.
