It seems that condo boards and landlords are hearing increasingly from New Yorkers who find their homes reeking from cigarette smoke seeping in from neighbors' apartments and condos.
"This is the hot controversy in condos and co-ops right now," real estate lawyer Aaron Shmulewitz told the New York Sun Thursday.
The Sun said laws require building management to make an effort to curb secondhand smoke. As a result, some smokers have been unable to renew their leases even though smoking is not specifically prohibited in their buildings.
Shmulewitz noted that tenants are becoming less tolerant of their neighbors' tobacco habit due to the fact that more people don't smoke and are increasingly wary of the potential health risks of breathing secondhand smoke.
