NEW YORK, Sept. 13 (UPI) -- A judge in New York says 37 families can sue Boston's Massport and the airlines for the deaths of family members on Sept. 11, 2001.

The first jury trial is set to start Sept. 24, the Boston Herald said Wednesday.

At Tuesday's final pre-trial hearing, U.S. District Judge Alvin K. Hellerstein stopped to honor the memory of the nearly 3,000 who perished. He then set the rules for the court cases.

The newspaper said the families have refused to settle or take their share of the government’s September 11 Victims Compensation Fund.
