LEXINGTON, Ky., Aug. 27 (UPI) -- The sole survivor of a plane crash that killed 49 people last summer is suing the designer of Kentucky's Blue Grass Airport.
Co-pilot James Polehinke filed suit in Fayette Circuit Court blaming AVCON Inc., for the crash of Comair Flight 5191, the Lexington (Ky.) Herald-Leader reported Monday.
Polehinke's suit filed Friday claims pilots had complained the design and lighting of the airport's runways were "erratic, haphazard and/or improper," the newspaper said.
Flight 5191 crashed while trying to take off on a too short wrong runway -- which the suit says was unlit in the dark of morning. Polehinke is recuperating from severe injuries suffered in the crash.
