
ATLANTA, July 12 (UPI) -- A sex videotape used to convict an Atlanta-area teenager of sex with a minor shouldn't have been distributed to legislators, a U.S. attorney said.
U.S. Attorney David Nahmias issued a statement Wednesday saying Douglas County District Attorney David McDade violated federal child pornography laws by giving copies of the tape to state legislators and journalists.
McDade said he did so under provisions of a state open records law but Nahmias said federal law trumps state law, the Atlanta Journal-Constitution reported Thursday.
In his statement, Nahmias said possession of the tape showing a then-17-year-old male having sex with two girls, 15 and 17 in a motel room, was illegal.
"These laws are intended to protect the children depicted in such images from the ongoing victimization of having their sexual activity viewed by others, potentially for years to come, particularly if the images are placed on the Internet or otherwise broadly enter the public domain," Nahmias said.
