
SOMERVILLE, N.J., May 29 (UPI) -- A judge must decide whether a New Jersey couple charged with drowning their newborn grandson in the toilet should be tried together.
Prosecutors in Somerset County argued Tuesday that Patrick and Deborah McCabe of North Plainfield should have separate trials because they made statements to police incriminating each other. Lawyers for the couple plan to file motions that the statements are inadmissible, The Star-Ledger of Newark reported.
"They can't afford to be tried separately, either emotionally or financially," said Anthony Palumbo, Patrick McCabe's attorney.
Investigators say the couple's 16-year-old daughter delivered a full-term, 5-pound baby in their house Dec. 11, 2005. The McCabes, who allegedly left the baby in the toilet for two hours, are charged with aggravated manslaughter.
