Prosecutors want Marion Barry in jail

WASHINGTON, March 8 (UPI) -- Federal prosecutors in the nation's capital have asked a judge to send former Washington Mayor Marion Barry to jail on a tax evasion charge.

In a court filing, prosecutors said Barry, after being granted a probationary sentence for failing to file tax returns for six years, then did not file his next year's return on time, The Washington Post reported.

Barry, now a member of the City Council in the District of Columbia, "has not acted like a person who has been given the opportunity of probation, and should not be treated like one," prosecutor said.

In 2005, Barry pleaded guilty to a misdemeanor tax charge. He received a sentence of three years probation with one condition that he start filing tax returns on time.

Barry is no stranger to the legal system. He was convicted of possession of crack cocaine while he was mayor and served six months in prison.
