Romney to sue for same-sex referendum

BOSTON, Nov. 20 (UPI) -- Massachusetts Gov. Mitt Romney said he will ask the state's highest court to put the issue of same-sex marriages to the state's voters.

Romney said Sunday before a gathered crowd of supporters that the state's Legislature violated the constitution by voting 109 to 87 to go into recess Nov. 9 rather than vote on a proposition that would allow for a public referendum on a gay marriage ban, the Boston Globe reported Monday.

"The issue before us is not whether same-sex couples should marry. The issue before us today is whether 109 legislators will follow the constitution," Romney said.

The governor said he would send copies of the constitution to the 109 lawmakers along with a copy of their oath of office.

Romney's office is expected to file the lawsuit with the Supreme Judicial Court sometime this week in an attempt to get the measure on the 2008 ballot, the Globe said. A spokesman for Romney's office said the suit will ask the court to force Secretary of State William Galvin to put the measure on the ballot, claiming the Legislature is obstructing democracy.
