
AUSTIN, Texas, Dec. 13 (UPI) -- The prosecutor in the case against U.S. Rep. Tom DeLay, R-Texas, wants a halt in the trial as he appeals the dismissal of conspiracy charges against DeLay.
Any postponement in the trial, however, would prevent Delay from regaining his U.S. House Majority Leader post because he would still be under indictment, the Austin American-Statesman reports.
Travis County District Attorney Ronnie Earle is appealing Senior District Judge Pat Priest's decision last week dismissing charges that accused DeLay and two co-defendants of conspiring to violate a law barring the use of corporate money in a political campaign.
Priest also refused to throw out the more serious charges that DeLay, John Colyandro and Jim Ellis laundered corporate money and conspired to launder money into political donations during the 2002 elections.
DeLay lawyer Dick DeGuerin said Earle's move to appeal is only designed to postpone the proceedings.
