Defense says prosecutors lack evidence

AUSTIN, Texas, Dec. 12 (UPI) -- The lawyer for U.S. Rep. Tom DeLay, R-Texas, says prosecution has no evidence the lawmaker knowingly raised corporate campaign cash to skirt a state ban.

Dick DeGuerin says a judge's ruling requires Travis County District Attorney Ronnie Earle prove DeLay and two others raised or converted corporate cash to get around the state's ban on using such money in campaigns for elective office, but that the prosecution lacks evidence about any such scheme, reports the Houston Chronicle.

In a ruling last week, Senior District Judge Pat Priest upheld charges of money laundering and conspiracy to commit money laundering against DeLay, Jim Ellis and John Colyandro. But Priest also said Earle must show the men violated the law by knowingly and intentionally doing it.

The state law prohibits corporate money from being used in campaigns for elective office, but such money can be legally raised by a political committee to pay for administrative expenses. DeLay's lawyers claim the money was raised legally, and that it was spent on legitimate administrative expenses.
