New DeLay judge sets Nov. 22 hearing date

AUSTIN, Texas, Nov. 8 (UPI) -- The new judge in the criminal trial of U.S. Rep. Tom DeLay, R-Texas, set Nov. 22 as the first hearing date in the trial for campaign-related money laundering.

In Austin, Senior Judge Pat Priest also heard motions from DeLay to move the trial nearer to Houston, as DeLay said in an affidavit he does not believe he can receive a fair trial in heavily Democratic Travis County.

Texas election code requires trials to be held in "the county of residence of the defendant," DeLay lawyer Dick DeGuerin argued.

There also are motions before Priest to quash the indictments against DeLay and to sever his trial from his co-defendants, John Colyandro and Jim Ellis, the Houston Chronicle reported.

DeLay's codefendants are pursuing a legal strategy that questions whether the charges against them are constitutionally valid, the Austin American-Statesman reported. DeLay, however, is seeking a speedier trial in hopes of regaining his position as U.S. House of Representatives majority leader, from which he was forced to step down after being indicted.
