Court rejects Traficant review

WASHINGTON, Jan. 10 (UPI) -- The U.S. Supreme Court Monday refused to review the case of ex-Rep. James Traficant Jr., D-Ohio, who is serving a prison term for bribery.

Traficant was expelled from the U.S. House after his conviction and shortly before being sentenced to eight years in prison in July 2002. The former congressman maintains the House procedure and the criminal trial placed him in unconstitutional double jeopardy -- that he was tried twice for the same offenses.

He also questions whether his jury, selected from Cleveland rather than the Youngstown area he represented, was a "jury of his peers" as required by the Constitution.

An appeals court said the evidence showed Traficant "demanded thousands of dollars ... in return for official favors ... paid inflated salaries to his staffers, who were then required to kickback the difference to their boss; and forced his congressional staffers to bale hay, repair plumbing and reinforce barns at his show-horse farm."
