Former Rep. Janklow seeks appeal

SIOUX FALLS, S.D., Nov. 16 (UPI) -- Lawyers for former Rep. Bill Janklow argued before the South Dakota Supreme Court Tuesday their client did not recevive a fair trial.

The former governor and congressman from South Dakota was convicted last year of manslaughter for driving a car that killed motorcyclist Randy Scott. Janklow, a diabetic, claimed he was disoriented because he had not eaten anything that day.

The appeal was based on issues of evidence and instructions given to the jury. Janklow's attorneys are asking the manslaughter conviction either be dismissed or Janklow be granted a new trial, reported KELO-TV, in Sioux Falls, S.D.

As governor, Janklow appointed all the supreme court's justices, so all five excused themselves and were replaced by circuit court judges.

A decision is expected in several months.
