Florida contests Terri Schiavo ruling

MIAMI, Oct. 5 (UPI) -- Gov. Jeb Bush has asked the Florida Supreme Court to reconsider its ruling voiding a law allowing a brain-damaged Tampa, Fla., woman to live.

The court struck down "Terri's Law" that allowed Bush to order a feeding tube that had been keeping Terri Schiavo alive. The tube had been removed by her husband under lower court decisions that ruled she was in a permanent vegetative state.

The Supreme Court ruled that the law, hastily passed by the Legislature so Bush could keep Schiavo alive, was a violation of the constitutional concept separation of powers.

Bush said the ruling would improperly limit the government's ability to operate.

"The Florida Legislature has passed numerous laws giving governors broad discretion in specific circumstances," Bush said. "The court's ruling could call those laws into question, and may limit the Legislature's ability to govern."

Schiavo, 40, has been in a coma-like state since 1990 when she suffered cardiac arrest and spent several minutes without oxygen getting to her brain.
