Embryo mix-up prompts lawsuits, settlement

SAN FRANCISCO, Aug. 4 (UPI) -- A San Francisco fertility clinic will pay a woman who received a wrong embryo $1 million to settle a lawsuit, the San Francisco Chronicle reported Wednesday.

Although Steven Katz, who runs Fertility Medical Associates of the Bay Area, knew Susan Buchweitz had the wrong embryo implanted into her womb, he did not tell her.

The $1 million payment settles Buchweitz' negligence suit against Katz.

Buchweitz is still suing the embryologist, Imam El Danasouri, for mistakenly giving her the wrong embryo.

Buchweitz, who found out about the mixup from a third party, is also locked in a custody battle in Santa Clara County with the man whose sperm was mistakenly used. The unidentified man is seeking full custody of the boy, now 4 years old, and has been granted visitation rights.

A 52-year-old interior decorator, Buchweitz called the custody fight an "on-going nightmare," and said the settlement with Katz was bittersweet.
