Texas congressman loses another bout

SAN ANTONIO, May 11 (UPI) -- A veteran Texas congressman Tuesday lost another round in a court battle to save his job.

State Judge Joe Hart ruled against Rep. Ciro Rodriguez, of San Antonio, in his fight for the Democratic nomination in the 28th District, the San Antonio Express-News reported.

Buck Wood, Rodriguez's attorney, said he would appeal Hart's decision not to allow evidence alleging ballot fraud and illegal votes during the May 9 primary.

Henry Cuellar won the most recent recount by 58 votes. If he wins the Democratic nomination, he will face Republican Jim Hopson of Sequin in the general election.

Cuellar told reporters later he wanted to extend a hand of friendship to Rodriguez supporters, officials and voters as the Democratic nominee.

Rodriguez said he expected the case would have to be appealed and he remains optimistic.
