
BERNALILLO, N.M., March 23 (UPI) -- A dispute over same-sex marriage may land New Mexico's attorney general and one of the state's county clerks in a courtroom showdown.
Sandoval County Clerk Victoria Dunlap says she planned to resume issuing same-sex marriage licenses Tuesday, the Albuquerque Journal reported.
But Attorney General Patricia Madrid earlier said state law defines marriage as between a man and a woman, after Dunlap had licensed more than 60 same-sex couples.
Madrid's advisory letter said the Sandoval County licenses were invalid and should not have been issued.
"Attorney General Patricia Madrid is extremely disappointed that the Sandoval County clerk is considering acting contrary to the statutes cited in her letter," said Paul Nixon, spokesman for Madrid.
"If the county clerk does act contrary to the attorney general's advisory letter, she will take appropriate action."
In response a lawyer for Sandoval County threatened Madrid Monday with a restraining order.
