DAYTON, Ohio, March 18 (UPI) -- An Ohio man filed a class-action lawsuit Thursday in Montgomery County Common Pleas Court against a business that sells male enhancement products.
David Parker purchased an eight-month supply of Enzyte for $399.60 in 2001, after reading published briefs that the product would enlarge his penis, Dayton Daily News reported Thursday.
The lawsuit claimed "the so-called 'research' referenced did not exist or did not constitute competent and reliable scientific evidence."
Parker took Enzyte for the directed eight-month period, but "experienced no increase," the suit said.
When Parker called distributors Berkeley Premium Nutraceuticals Inc., Cincinnati, for a refund, he was denied.
"Mr. Parker went to get his double-your-money-back offer, and they said it was no longer in effect," one of Parker's lawyers said.
The lawyer said the company recently backed off claims its product enlarges size, but Parker relied on earlier advertisements published in Esquire and GQ magazines.
