MANILA, Philippines, Dec. 25 (UPI) -- Prosecutors warn former Philippines President Joseph Estrada may be planning a trip to the United States to avert a potential death penalty trial.

A Filipino court granted Estrada permission to post a $24,400 bond and go to the United States for three months for a knee operation.

Chief prosecutor Dennis Villa-Ignacio, however, charged Estrada could use the court ruling to skip his trial since the U.S.-Philippines extradition treaty does not cover capital offenses, the Australian newspaper reported.

"We are surprised and disappointed by the ruling and we're worried Estrada will never come back," Villa-Ignacio said.

Estrada, 66, who was forced from office and is accused of corruption, denied he is planning to go into exile.
