Judge dismisses Marine death suit

DETROIT, Dec. 18 (UPI) -- A U.S. judge in Detroit has dismissed a negligence suit filed by the family of a Marine who died in boot camp though he said the law he followed was unfair.

U.S. District Judge Bernard Friedman said he based his decision Wednesday on the Feres Doctrine of 1950 which stopped the family of Justin Haase from suing the military for neglect in his questionable death while in training.

"It's a sad case," Friedman said during the hearing, the Detroit Free Press reported. "It screams, it screams, it screams. ... It's not fair."

Haase, 18, of Chesterfield Township, Mich., died of bacterial meningitis in boot camp at Parris Island, S.C., on Dec. 23, 2001, after complaining of headaches and cold-like symptoms. He wasn't provided with antibiotics that are standard for every new recruit, and though he complained of illness several times in November and December that year, he wasn't properly treated, his family said.

The family is expected to appeal.
