Foster autopsy photos at stake in case

WASHINGTON, Dec. 3 (UPI) -- The Supreme Court heard argument Wednesday on whether the independent counsel is compelled to release the Vince Foster autopsy photographs.

Five investigations have found Foster, a deputy counsel in the Clinton White House, committed suicide while depressed in 1993.

But California attorney Allan Favish is among those conspiracy theorists who believe Foster was slain.

The Freedom of Information Act requires the government to release information gathered for law enforcement purposes but has a privacy exemption. The larger issue in Wednesday's argument is whether the privacy exemption in FOIA extends to the deceased's survivors or dies with a person.

Favish told a largely skeptical Supreme Court: "We are now 100 percent certain that there was negligence" in independent counsel Kenneth Starr's reporting of the investigation.
