
LOS ANGELES, July 31 (UPI) -- A Los Angeles jury ruled in favor of Philip Morris USA Inc. Thursday, rejecting allegations the tobacco giant was responsible for a man's lung cancer.
Philip Morris said in a statement the Superior Court jury determined the dangers of smoking have been well known for decades, and plaintiff Frederic Reller took up the habit despite the dangers.
Philip Morris Vice President William Ohlemeyer said he believes the jury's decision "makes common sense and legal sense."
The win for Philip Morris was the first in Los Angeles County and a rare victory for the tobacco industry in a state where smoking lawsuits are frequently decided in favor of plaintiffs.
Reller sought $17 million in damages. His lawyers said they plan to seek a retrial on a fraud count the jury was unable to decide.
