CANANDAIGUA, N.Y., Sept. 24 (UPI) -- Tony Stewart will not face criminal charges in the death of Kevin Ward Jr.

A grand jury decided there is insubstantial evidence to charge the 43-year-old race car driver, according to TMZ.

Stewart was racing in a sprint car event when he struck and killed Ward on August 9. The driver had pushed Ward's vehicle off the track, and the 20-year-old competitor got out and approached Stewart's moving car in what seemed to be an effort to confront him. The vehicle spun out and hit Ward, who was pulled underneath and later pronounced dead at the hospital.

Stewart dropped out of three subsequent races, and called Ward's death "one of the toughest tragedies [he's] ever had to death with" and "something that will definitely affect [his] life forever."

The jury reportedly had access to "enhanced" video of the accident, but the footage did not sway the decision.
