Diehl's deal completed, 2012 drunken driving charge to be erased

NEW YORK, Aug. 20 (UPI) -- New York Giants tackle David Diehl will have his drunken driving charge erased after a judge said Diehl had successfully finished the terms of a plea deal.

In a hearing in New York City's Queens borough, Supreme Court Judge Toko Serita said an additional charge of driving while impaired would be dropped if Diehl stayed out of trouble for a year, the New York Daily News reported Monday.

The NFL player had pleaded guilty to an aggravated DWI charge in February. Police who arrested him said his blood-alcohol level was 0.18 when he collided with a row of parked cars outside an Astoria bar last summer.

The plea deal called for six months probation and required Diehl to wear for 90 days a bracelet that monitors blood-alcohol content. He also had to pay $1,200 in restitution and a $550 fine.

In addition, he was ordered to participate in the NFL's substance abuse treatment program.

Diehl, 32, has played offensive tackle for the Giants since 2003 during which time the team won two Super Bowls.
