Francisco Rodriguez skips court date

NEW YORK, Oct. 25 (UPI) -- Pitcher Francisco Rodriguez, required to testify in a case brought by his former girlfriend's father, did not attend a deposition, the plaintiff's lawyer said.

Rodriguez pleaded guilty to the 2010 attempted assault of Carlos Pena, the father of Daian Pena, Rodriguez' girlfriend at the time and the mother of his twin children. Pena is seeking unspecified damages for injuries he suffered to his back and neck in the incident in the New York Mets clubhouse at Citi Field, the New York Daily News reported.

Rodriguez now plays for the Milwaukee Brewers.

Of the failure to appear in court, Edward Gersowitz, Pena's lawyer, said, "We did not get a reason and I can only wonder whether it is an attempt to deny Mr. Pena his day in court."
