

SAN JOSE, Calif., Feb. 7 (UPI) -- California prosecutors say they don't have enough evidence to charge a San Jose Sharks fan who allegedly knocked a brain tumor patient unconscious.
The case involves a Dec. 28 incident at a Sharks game. Maggie Herger, 12, of Canada was sporting Vancouver Canucks clothing and was knocked to the ground allegedly by the drunken woman behind her as she celebrated a Sharks goal, the San Jose Mercury News reported. Earlier, Herger said she had been harassed verbally about her Canucks shirt.
Saying no one should have to worry about their safety at a sporting event, Santa Clara County Assistant District Attorney David Howe issued a statement saying, there just was not enough evidence to file charges since no one actually witnessed the incident.
"Our hearts go out to the young woman and her family," Howe said Monday.
Herger underwent brain surgery after the attack.
