Sonics seek to head off class-action suit

SEATTLE, July 30 (UPI) -- The owners of the Seattle SuperSonics contend jilted season ticket holders are too diverse to justify a class-action lawsuit.

Lawyers for the ownership group led by Clay Bennett said in court documents that Seattle fans who bought season tickets had too many different motivations for their purchases to be considered a single group.

"It is readily apparent that the reasons why each of those 349 persons renewed for 2007-08 are highly personal and not susceptible to class treatment," attorney John Tondini wrote. "Some renewed because they always renew. Some renewed because they use the tickets for business clients, employee recognition and the like."

The Seattle Post-Intelligencer Wednesday said argument was aimed at blocking a motion to have the fan lawsuit declared a class action and limit the defendants to the three ticket holders who filed the action.

The fans sued on the grounds Bennett misled them with a marketing offer of a three-season price freeze for renewing prior to the NBA's approval of the team's move to Oklahoma City.
