Stephens, who was expected to take the case against members of the Blue Devils lacrosse team, has sealed one or more indictments according to the Charlotte (N.C.) Observer, and a source told the newspaper that the grand jury issued indictments against two players on Monday.

Eighty-one indictments were made public after the grand jury adjourned, but none were for members of the lacrosse team. Judges have the authority to seal indictments to prevent the leaking of information about criminal charges until the suspects are arrested.

Tracy Powers, a paralegal for defense lawyer Bob Ekstrand, confirmed there were two sealed indictments against Duke lacrosse players.

A 27-year-old female alleged that three Duke lacrosse players raped and choked her at an off-campus party where she was hired to perform as an exotic dancer on March 13.
