Alleged banana assault lands Florida man behind bars

Fruit fight leads to charges of domestic battery and resisting arrest without violence.

A Florida man and his girlfriend may split after an alleged banana attack on New Year's Eve resulted in a domestic battery charge.

After responding to the Pasco County home of 36-year old Joseph Smolinsky early on Wednesday morning, authorities say that his girlfriend told them he threw a banana at her which struck her in the face.

Smolinsky denied his role in the alleged fruit fight and said that his girlfriend threw the banana at him.

The arresting deputy noticed that the victim’s face was red in the area where she said the banana struck her and saw pieces of the peel near where she was sitting.

When the deputy attempted to arrest Smolinsky, he resisted and had to be pepper-sprayed. After being taken into custody, Smolinsky was charged with domestic battery and resisting arrest without violence.

He was scheduled to appear in court on Thursday afternoon.
