After Powers told Broward Circuit Judge Marc Gold what had happened, Gonzalez was charged with dual misdemeanors each punishable by up to a year in jail.

"You killed my son," Gonzalez reportedly said. "I will be watching you."

According to court records, he was previously arrested in 2006 and charged with aggravated assault with a deadly weapon, leaving the scene of an accident and reckless driving. Gonzalez did not contest the charges and was sentenced to three years of probation.

During the arraignment, Powers, who is charged with DUI manslaughter and manslaughter with an unlawful blood alcohol level, pleaded not guilty in the death of Juan Gonzalez Jr.
