Texas lawsuit: Racial slur printed on wedding reception photos

The lawsuit alleges a photo booth rented from Premiere Photography of Houston printed pictures using a racial slur.

HOUSTON, April 1 (UPI) -- A Houston couple's lawsuit alleges pictures from a rented photo booth at their wedding reception came out with a racial slur printed on them.

Cathy Hale, an attorney for the Houston couple, said the photo booth rented from Premiere Photography at the August 2012 wedding reception printed some pictures with the wedding date and the caption, "Poor [expletive] Party."

Hale said her clients, who she asked not to be named, did not know about the pictures until family members informed them a few months after the wedding. She said the husband contacted James Evans, the owner of Premiere Photography.

"[He] said, 'what happened, how could this happen, please tell me how this occurred,' and the only response that he got after that conversation was, 'sue me,'" Hale told KPRC-TV.

The attorney said the lawsuit was filed because Evans failed to act.

"This has never been about the money. My clients did not call a lawyer as soon as they found out about this, they called Mr. Evans, and Mr. Evans did nothing," Hale said. "It's about righting a wrong, it's as simple as that."

The lawsuit alleges negligence and breach of contract under the Texas Deceptive Trade Practices Act.

"They trusted this company to provide them with a service on their most important day and what they got was the complete opposite they got a slap in the face. Every time they think about their anniversary, they think about this. It's never going to go away," Hale told KTRK-TV.

An attorney for Evans, who declined to comment, filed documents denying wrongdoing and suggesting the possibility of the booth being tampered with by someone else. The documents said too much time passed between the reception and Evans being contacted for the business owner to be able to determine which employee was working the event.

The documents filed by Evans' attorney said he offered to refund the couples' money, but they declined.

Mediation in the case is scheduled for Thursday and a trial is set to begin in July if an agreement is not reached.
