Photographer sued over Empire State topless pics

NEW YORK, Jan. 14 (UPI) -- The owners of New York's Empire State Building are suing a photographer who took pictures of a topless model at the top of the skyscraper.

The lawsuit, filed Monday in Manhattan Supreme Court, said commercial photographer Allen Henson held an "objectionable and inappropriate topless" photo shoot on the building's observation deck Aug. 9, 2013, as part of his "self-style 'boobs around town project,'" the New York Post reported Tuesday.

"At the time that [Henson] and the model entered the observatory, it was crowded with visitors, including children," the lawsuit states.

The suit said Henson damaged the reputation of the building with his unauthorized shoot and forced the owners to beef up security.

The lawsuit is seeking $1.1 million in damages, the New York Daily News reported Tuesday.

"Breasts are dangerous? I'll take the publicity but it's hard to take this seriously," Henson said.

Henson said the pictures were not for "commercial purposes," as the suit alleges, but rather for a personal project that was dubbed "Boobs Around Town" by other parties.
