LIVONIA, Mich., Sept. 18 (UPI) -- A lawyer for a Michigan man who lost his lawsuit alleging snack price gouging at movie theaters said he advised his client to buy a subscription to Netflix.
Circuit Judge Kathleen Macdonald ruled in a 45-minute hearing Friday to dismiss the lawsuit Jason Thompson brought against an AMC Theater in Livonia, saying the Michigan Consumer Protection Act does not apply to businesses regulated by other laws, the Detroit Free Press reported Tuesday.
"There's not much hope that the Court of Appeals or the Michigan Supreme Court will wake up and say their previous rulings have completely eviscerated the Michigan Consumer Protection Act," said Thompson's lawyer, Kerry Morgan of Wyandotte.
Morgan said his client likely will not appeal the ruling.
Thompson had alleged the movie theater was violating the law by overcharging customers for concessions.
"I told my client to buy a subscription to Netflix for the price of a bag of popcorn and a drink and vote with his feet and his pocketbook," Morgan said.
