CAPS said the donkey appeared to be in distress in video footage of the promotion. PETA said it received a promise from the restaurant's owner "not to use animals at our events and promotions and we are looking forward to ... discussing how we can work together in the future."

However, the group said the Pink Taco made a similar promise following a 2008 incident involving a donkey.

The restaurant's owner could not be reached for comment, the Times said.
