DELRAY BEACH, Fla., Jan. 31 (UPI) -- A restaurant owner in Arizona alleges the owners of an eatery in Delray Beach, Fla., stole the theme behind his Heart Attack Grill.
Heart Attack Grill owner Jon Basso alleges in a federal lawsuit the owners of the Heart Stoppers Sports Grill in Delray Beach copied his theme of having a restaurant with a medical theme and unhealthy foods, the South Florida Sun-Sentinel said Friday.
"Heart Attack Grill is the originator of the medically themed hamburger grill and restaurant," Basso's attorney, Robert Kain, alleges. "It sells high-calorie food products and we have had very extensive media coverage, including numerous shows on the Travel Channel and the Food Network."
The Sun-Sentinel said an attorney for Heart Stoppers insists the theme behind the eatery opened by Iggy Lena and Bob Kutnick is not identical to that of the Heart Attack Grill.
"Their theme is completely different," attorney Eric Lee said in response to the U.S. District Court suit.
"They didn't steal the same trademarked Single Bypass, Double Bypass burger that he does," he added.
