SARASOTA, Fla., Jan. 22 (UPI) -- The handler caring for a baby chimpanzee at the center of a Florida custody battle said she needs to bring the chimp with her to court.

Virginia Valbuena said she needs to bring 13-pound Eli the chimpanzee with her to Sarasota County Circuit Judge Charles Roberts' courtroom for a hearing because he still requires 24-hour care and she does not have a qualified sitter, Sarasota (Fla.) Herald-Tribune reported Friday.

James Casey of Missouri, who brought the custody suit against Valbuena, said he believes Eli was born on a chimpanzee farm he used to run with his ex-wife and therefore still belongs to him. However, Valbuena, who used to do business with Casey's ex-wife, said the chimp came from a California wildlife park.

Casey is seeking to have a paternity test performed on the chimp to determine whether it was born on his farm. Valbuena's attorneys said they oppose a paternity test due to the potential for fraud.
