Teen accused of drinking in buggy

LITTLE VALLEY, N.Y., May 13 (UPI) -- Police in Cattaraugus County, N.Y., said a 17-year-old charged with underage possession of alcohol was drinking beer while riding in his Amish buggy.

Sheriff's deputies said Chris Slabaugh, 17, was charged Monday night after he was spotted drinking Busch beer while riding in his buggy in the Town of Leon at about 11:45 p.m., The Buffalo (N.Y.) News reported Wednesday.

Authorities said Amish buggies do not fall under New York's Vehicle and Traffic Law.

"It's not a motor vehicle," Cattaraugus County Sheriff's Capt. Robert Buchhardt said. "The only thing you could charge him with was the possession of alcohol. If you had an Amish (youth), and he was intoxicated and driving the buggy, you couldn't charge him with DWI. It's not a motor vehicle."

Emanuel Miller, 22, was charged with unlawfully dealing with a child after he allegedly gave the beer to Slabaugh.
