Suit seeks return of ex's engagement ring

FAIRFIELD, Conn., Nov. 19 (UPI) -- A Fairfield, Conn., man is suing his ex-fiancee, demanding the return of the engagement ring he gave her.

Bryan Rosen filed a Superior Court lawsuit Monday against Daniela Marcoccia, seeking the return of the $25,000 diamond ring he gave her at the time of her marriage proposal in June 2007, The (Bridgeport) Connecticut Post reported Wednesday.

"In a situation like this an engagement ring is a conditional gift of the marriage, and if the marriage doesn't take place, the man is entitled to get it back," said Erich Gaston, Rosen's attorney. "That's the law."

The suit says Rosen broke off the planned July 26 wedding after an alleged May incident that involved Marcoccia angrily throwing the ring at Rosen and telling him she did not want to marry him. However, Rosen's suit says that when he attempted to officially end the engagement, Marcoccia refused to return the ring.
