NEW YORK, Aug. 25 (UPI) -- A New York man convicted in a hit-and-run death in 2005 is suing the city after his car, a 2005 Bentley Continental, was allegedly damaged while impounded.

Harry Shasho, 38 -- who pleaded guilty to leaving the scene of an accident without reporting it after the Oct. 1, 2005, death of pedestrian Louis Couch, 54 -- claims in his suit that his car "was in excellent condition, proper working order and fully functional ... with no noticeable defects or damage" when it was impounded by police, the New York Post reported Monday.

However, Shasho claims that during the one and a half years the car was in the impound lot officers allowed mold and water damage to take hold, "rendering the vehicle inoperable."

The suit, which is seeking $190,000 from the New York Police Department, claims Shasho's property rights were violated by the department's failure to return the car in "good condition."
