Mister Softee: Knockoffs playing our song

TRENTON, N.J., July 10 (UPI) -- Mister Softee, the New Jersey-based company famed for its roving ice cream trucks, has sued three alleged impostors who used its trademark music.

Jim Conway Jr., son of the company's founder, said he initiated the legal action after he heard the song coming from a strange truck in Newark, The Star-Ledger of Newark reported. Danny's Soft-Serve, the truck he spotted, is one of three defendants named in the suit.

Mister Softee, founded in 1956, franchises more than 600 trucks, including two in China. Conway said that the company is known for its high standards.

"It's easier to attract people to get out of their houses if they think it's Mister Softee," Conway said. "If you want to get into the hamburger business and thought you could get away with putting up a store with golden arches, wouldn't you do that?"

Lafi Rahman, who owns a Mister Softee franchise, said the impostor Conway saw learned his route. He said the truck would hit his regular stops an hour before he did, but he said he has not seen "Danny" since school vacation began.
