Jury deadlocked in phony gun trial

SAN FRANCISCO, April 14 (UPI) -- Prosecutors in California have to decide whether to retry a homeless man accused of using a toy gun to make someone give him 50 cents for beer.

A San Mateo County jury deadlocked 8-4 Friday, favoring acquitting Stephen Paul Quiles, 42, of felony robbery, which could land him in jail for up to five years, the San Fransisco Chronicle reported Saturday.

Prosecutors now have to choose if they will take another shot at the case they say was a robbery, not a misunderstood mooch for cash as the defense contends.

Quiles was being held on $100,000 bail Saturday, awaiting a Thursday hearing to decide if his case will go to trial a second time.

The suspect was at Chestnut Cleaners in San Francisco Jan. 17 when he allegedly flashed a phony handgun at Ernesto Dicicco before asking him for 50 cents.

Dicicco said in court that he forked over the change because he was afraid Quiles would open fire on him.
